UNANIMOUSLY RESOLVED that:
a. The subdivision of Portion 77 of Cape Farm No. 20, Klein Dassenberg into Portion A and the Remainder, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions in Annexure A.
b. The regulation departure to permit a property size of less than 20ha for proposed Portion A and the Remainder Portion 77 of Cape Farm No. 20, Klein Dassenberg, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions in Annexure A.
c. City approval to permit the subdivision into two within the 5 – 16km Koeberg Overlay Zone on Portion 77 of Cape Farm No. 20, Klein Dassenberg, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
d. Consent to provide more than one additional dwelling unit per 10 hectares on Portion 77 of Cape Farm No. 20, Klein Dassenberg, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
e. Consent to exceed the permissible number of additional dwelling units from five (5) to fourteen (14) on Portion 77 of Cape Farm No. 20, Klein Dassenberg, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
f. City approval to permit development in the form of additional units and floor space within the 5 – 16km Koeberg Overlay Zone on Portion 77 of Cape Farm No. 20, Klein Dassenberg, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
g. The regulation departure to exceed the permitted floor space from 1500m2 to 2249m2 on Portion 77 of Cape Farm No. 20, Klein Dassenberg, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
h. The regulation departures related to building lines as listed below on Portion 77 of Cape Farm No. 20, Klein Dassenberg, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015:
- to permit dwelling units 5 and 19 to be at 9.5m in lieu of 15m from the north-west common building line on Portion 77 of Cape Farm No. 20, Klein Dassenberg;
- to permit dwelling units 15 and 19 to be at 10m in lieu of 15m from the north-east common building line on Portion 77 of Cape Farm No. 20, Klein Dassenberg; and
- to permit dwelling unit 10 and 11, and the storage structure to be at 12m in lieu of 15m from the east common building line on Portion 77 of Cape Farm No. 20, Klein Dassenberg.

The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report
