For noting by Subcouncil 3:

In terms of section 14(2)(a) and (b) of the Municipal Finance Management Act (MFMA), Act 56 of 2003.

Council resolve that Erf 12339, situated at 75 Porterfield Road, Blouberg Rise, Milnerton in extent approximately 2 248m², zoned Single Residential 1: Conventional Housing, shown lettered ABCDEF on the attached plan LIS 2140 (Annexure A), not be required for the provision of the minimum level of basic municipal services;

Council confirm that the fair market value of the asset described (a)(i) and the economic and community value to be received in exchange for the asset described in (a)(i) have been considered.

In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R.878 promulgated on 22 August 2008, Council approve in principle the transfer of Erf 12339, Blouberg Rise, Milnerton as described in (a)(i);

Erf 12339, Blouberg Rise, Milnerton be transferred by way of public competition, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority.

FURTHER RESOLVED

That the reserved price for the Erf should not be lower than the market related value that was established and that the advert must clearly indicate that there is a market related value and only tender prices that is in line with market related valuation will be considered.
