Subcouncil 18 RECOMMENDS that the lease of portion of public street, being a portion of Erf 68971 Cape situated at corner of Batts and Park Roads, shown hatched and lettered ABCDEFGH on the plan LT 1208v0 marked annexure A, in extent approximately 40m², to Mahmood Mohamed Fakier, owner of Erf 68971 or his successors in title, be approved subject to inter alia the following conditions, that:
a) A tariff rental of R418.26 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
b) The lease will endure for a period of ten years with an option to renew for a further 10 years subject any time to TWO MONTHS notice of termination.
c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
d) The property be used for security purposes only and no structures other than the existing structures will be permitted on the lease area.
e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
f) Subject to compliance with any other statutory requirements;
g) No compensation will be payable for any improvement made to the property.
h) All outstanding accounts with the City of Cape Town must be;
i) Electricity services are known to exist within the vicinity of the lease area and any alterations or deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicant’s cost.
j) A minimum clearance of 3 meters to the overhead mains conductors is to be maintained at all times. Should these clearances not be maintained for any reason, the necessary alterations will be carried out by the Department at the applicant’s cost.
k) No Telkom services are known to exist within the lease area but it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan;
l) It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times.
m) No excavations of filling shall be carried out within the lease area without prior consent of Council.
