UNANIMOUSLY RESOLVED
That it BE NOTED that the following applications for new liquor licenses were considered in terms of subdelegated authority and that the following recommendations were forwarded to the Liquor Authority in terms of the Western Cape Liquor Act 2008, as amended, during the period 01 March to 31 March 2018
A. LLA180202 – DIE HEUWEL
SubCouncil 07 recommends that the application for a liquor licence received from Die Heuwel for the sale of liquor for Consumption ON Premises, Reference No LLA1802020
BE CONDITIONALLY SUPPORTED, subject to:
An application for the correct Land Use being approved. Portion 2 of Farm 1428, Cape Farms is currently zoned for agricultural purposes which does not permit the proposed use as of right and according to file reference 18/6/4/66 and dams case reference 70392046, no approval has been granted for a function venue.
And further subject to:
1. The applicant must be in possession of (1) a Trade License in terms of the Business Act No 70 of 1991 and (2) a Certificate of Acceptability for Food Premises in terms of Regulation R962 dated 23/11/2012 promulgated under the Foodstuffs, Cosmetic and Disinfectants Act, 1972 (Act 54 of 1972).
2. At no time may a noise nuisance or a disturbing noise, as defined in the Western Cape Noise Control Regulations P. N. 200/2013 as promulgated under the Environmental Conservation Act, 1989 (Act 73 of 1989), be created to surrounding property owners.
3. No smoking must be allowed on any public premises unless it complies with the Tobacco Products Control Amendment Act, 2008 (Act No 63 of 2008) and Notice Relating to Smoking of Tobacco Products in public places, Regulation No R975 dated 29 September 2000. In this regard Guidelines or the design of designated Smoking Areas, and requirements for artificial ventilation that serves smoking areas, can be obtained from your local Environmental Health Practitioner.
B. LLA1803002 – VINONEERS PTY LTD
SubCouncil 07 recommends that the application for a liquor licence received from Vinoneers for the sale of liquor for Micro Manufacturer Off Consumption, Reference No LLA1803002
NOT BE SUPPORTED:
REASONS FOR NON-SUPPORT
The subject property is currently zoned Single Residential in terms of the City of Cape Ton Development Management Scheme. SR1 zone does not permit the sale of alcholic beverages. As a primary right, additional use righ and Consent use. The Home occupation does not allow it either. This department therefore does not support the proposal.
C. LLA1803003 – COPPER CLUB EATERY
SubCouncil 07 recommends that the application for a liquor licence received from Copper Club Eatery Durbanville for the sale of liquor for Consumption ON Premises, Reference No LLA1803003
CONDITIONALLY SUPPORTED, subject to:
1. The building is still under construction.
2. The building must be completed in accordance with the approved building plans and the necessary completion certificate must be obtained from the Building Management Development Department.
3. The applicant must be in possession of (1) a Trade License in terms of the Business Act No 70 of 1991 and (2) a Certificate of Acceptability for Food Premises in terms of Regulation R962 dated 23/11/2012 promulgated under the Foodstuffs, Cosmetic and Disinfectants Act, 1972 (Act 54 of 1972).
