It is recommended that the lease of erf 38381, bounded by Dumbe, Buza and Qhama Streets, Harare, Khayelitsha, shown lettered ABCDEF on the attached plan ET 233 marked annexure A, in extent approximately 860m2, to Bukwayo Educare Centre, or their successors in title, BE SUPPORTED subject to inter alia the following conditions, that: A)A tariff related rental of R835.96 per annum excluding VAT of 14% where applicable, being R117.04 ( in total R953) be payable; B)The lease will endure for a period of ten (10) years with an option to renew for a further ten (10) years; C)The rental will be adjusted annually in terms of the rental tariff structure as approved by Council; D)The property be used for social (educational – educare centre) purposes only; E)Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority; F)Subject to compliance with any other statutory requirement; G)No compensation will be payable for any improvement made to the property. H)That no structure is constructed over the municipal service and that a servitude, with a minimum width of 3,0m be registered over such service. This shall be for the cost of the applicant. I)That all Developmental Proposals with reference to the proposed crèche be submitted for Department: Transport’s evaluation and approval in terms of vehicular access points, on-site parking requirements etc. J)That the building complies with NBR (National Building Regulations), By-Law Relating to Community Fire Safety, and or any other pertinent regulations. K)That where any outdoor advertising is envisaged, the applicant must comply with the City’s Outdoor Advertising and Signage By-Law 10518 of 2001.
