Proposed granting on in-principle approval for the lease of a portion of erf 400 – Khayelitsha by means of a direct deal (out of hand) to Moya we khaya for the purpose of a garden BE SUPPORTED, to the following:
a)In terms of section 14(2)(a) and (b) of the Municipal Finance Management Act (MFMA), Act 56 of 2003:
i Council resolve that portion of ERF 400, Khayelithsa, situated at 8 Mfundisweni Road - Khayelithsa, in extent approximately 20 225m², zoned Public Open Space, indicated as the figure ABCDEFGHJKL shown hatched on plan LIS 1706v0 attached as Annexure A, not be required for the provision of the minimum level of basic municipal services;
ii Council confirm that the tariff based rental (value) of the asset described in (a)(i) and the economic and community value to be received in exchange for the asset described in (a)(i) have been considered;
a In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R.878 promulgated on 22 August 2008, Council approve in principle the lease of ERF 400, Khayelitsha, as described in (a)(i);
b) Portion of Erf 4000, Khayelithsa be leased (disposed) of by means of direct deal (out of hand) with the applicant, Moya we Khaya for Food Garden purpose, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority.
