Cllr Cassiem informed the members that he did a site visit and the community fully support the approval of the closure of the portion of Erf 39934 situated at Clara Road New Fields. He said the area is a crime hotspot and closure will bring value in area. The Subcouncil members unanimously SUPPORTED the recommendation that: a) Council resolve in terms of section 14 of the Local Government: Municipal Finance Management Act, Act 56 of 2003, that portion of Erf 399354 Cape Town (Public Street) situated at Clara road, Newfields, as depicted by the figures ABCDEFGH measuring approximately 434m² in extent on the attached sketch STC 2894 marked annexure a, is not required to provide the minimum level of basic municipal service; and has considered the fair market value of the asset and the economic and community value to be received in exchange for the asset. b) Council approve the granting of in-principle approval for disposal of portion of Erf 399354 Cape Town (Public Street) situated at Clara road, Newfields, as depicted by the figures ABCDEFGH measuring approximately 434m² in extent on the attached sketch STC 2894 marked annexure A, in terms of regulations5(1)(b)(ii) of the of Municipal asset Transfer Regulations; c) Council approve of the closure of a portion of Erf 399354 Cape Town (Public Street) situated at Clara road, Newfields, as depicted by the figures ABCDEFGH measuring approximately 434m² in extent on the attached sketch STC 2894 marked annexure A, in terms of section 4 of the City of Cape Town Immovable Property By-Law, 2015
