For the reasons set out in the report, it was RECOMMENDED that, The lease of portion of City Land, a portion of Erf 7000, Fish Hoek situated at Simon’s Town Road. Fish Hoek shown hatched and lettered ABCD on the attached Sketch marked annexure A, in extent approximately 93 m2, to C D Jones and A K Jones, owners of Erf 7529 or their successor in title, be approved subject to inter alia the following conditions that, a)A tariff rental of R 371.93 per annum excluding VAT of 14% where applicable, being R 52.07 (in total R 424.00) be payable; b)The lease will endure for a period of ten (10) years with an option to renew for ten (10) years; c)The rental will be adjusted annually in term of the rental tariff structure as approved by Council; d)The property will be used for security purposes only and no structures, other than boundary fencing will be permitted within the lease area; e)Subject to such further conditions to be imposed by the Director : Property Management in term of her delegated authority; f)Subject to compliance with any other statutory requirements; g)The submission and approval of any necessary building plans in term of the National Building Regulations if applicable; h)Any fencing that does not require the submission of plans in term of the National Building Resolutions will still require the approval of the Director: Property management; i)Any alterations or deviation to electricity services necessary as a consequence of the proposal. Or requested by the applicant, will be carried out at the applicant’s cost; j)It is the responsibility of the applicants to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan; k)It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times; l)If any plant not indicated exist and information or supervision is required the applicant Must contact Telkom’s office at least 48 hours before commence; m)It is recommended that, for the reasons set out in8.1 of the report, the concerns and objections received during the public participation process against the proposed lease not to be held; n)No compensation will be payable for any improvement made to the property.
