Subcouncil 19 supports and recommends that: The lease of portion of Public Place, being a portion of ERF 7000 Fish Hoek Shown hatched and lettered ABCDEFGHJK on the attached sketch LT 1051v.0 marked annexure A, in extent approximately 146 m2 , to CM Mudie, owner of erf 7454 on their successors in title, to be approved subject to inter alia the following conditions, that: (a)A tariff rental of R 742.98 per annum excluding VAT of 14% where applicable, being R104.02 (in total – R847) be payable; (b)The lease will endure for a period of 10 years with an option to renew for ten years; (c)The rental will be adjusted annually in terms of the rental tariff structure as approved by council; (d)The land will be used to regularize an existing encroachment purposes only and no fencing other than the existing fencing will be permitted within the lease perimeter; (e)Subject to further conditions to be imposed by the Director: Property Management in terms of her delegated authority; (f)Subject to compliance with any other statutory requirements; (g)Any alterations or deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant will be carried out at excavation cost; (h)No excavation is to take place on site without the possession of work. (i)It is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan. (j)It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times; (k)Adherence to the requirements of the City of Cape Town’s water-by-law; (l)Unrestricted access to the lease area where water meter services exists; (m)No compensation will be payable for any improvement made to the property; Action: Wilson Baartman
