Resolution detail
(a) Council resolve that, in terms of section 14 of the Local Government: Municipal
Finance Management Act, Act 56 of 2003, the subject portion of Erf 91484 Cape
Town, situated at Belfast Road, Wynberg, in extent approximately 48 m² and
shown by the letters ABCD Plan No LT 1166v0 attached and marked annexure A,
is not needed to provide the minimum level of basic municipal services; and has
considered the fair market value of the asset and the economic and community
value to be received in exchange for the asset.
(b) Council approve the granting of in-principle approval for disposal of a portion of Erf
91484 Cape Town, a Public Street, situated at Belfast Road, Wynberg, in extent
approximately 48 m² and shown lettered ABCD on the Plan No LT 1166v0
attached and marked Annexure A, to James Richard Parker and Mavis Ida Parker or
their successors in title, subject inter alia to the following conditions, that:
(i) A market-related purchase price of R45 000 excluding VAT of 14%, being R6 300
(in total R51 300), be payable;
(ii) The purchase price is to be escalated by 6% per annum compounded annually on
a pro rata basis commencing 6 months from date of valuation. Accordingly the
above recommended purchase price is to be adjusted as from 2017-05-01;
(iii) Subject to such further conditions to be imposed by the Director: Property
Management in the exercise of her delegated authority;
(iv) Subject to compliance with any other statutory requirements;
(v) All costs related to the transaction be borne by the applicants;
(vi) After subdivision the portion is to be consolidated with the applicants’
property, being Remainder of Erf 69758 Cape Town to form a single land
holding.
(vii) Any alterations or deviation to electricity services necessary as a
consequence of the proposal, or request by the applicant, will be carried
out at a the applicant’s cost
(viii) Adherence to the requirements of the City of Cape Town’s water by-law
and conditions.
(c) Council approve the closure of the portion of Erf 91484 Cape Town,
situated at Belfast Road, Wynberg, in extent approximately 48 m² and
shown by the letters ABCD Plan No LT 1166v0 attached and marked
annexure A, in terms of section 4 of the City of Cape Town Immovable
Property By-law, 2015.
