UNANIMOUSLY RESOLVED that:
a. The application for subdivision, as set out in Annexure A, on Erf 888 Camps Bay, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.



b. The application for removal / amendment of title deed conditions, as set out in Annexure A, on Erf 888 Camps Bay, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.

c. The application for removal / amendment of deemed land use conditions, as set out in Annexure A, on Erf 888 Camps Bay, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.

d. The application for departures, as set out in Annexure A, on Erf 888 Camps Bay, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.

e. The application for consent in terms of a title deed condition, as set out in Annexure A, on Erf 888 Camps Bay, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.

f. The application for removal of title deed conditions, as set out in Annexure A, on Erf 888 Camps Bay BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law 2015.

g. The application for removal of deemed land use conditions, as set out in Annexure A, on Erf 888 Camps Bay BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law 2015.

REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report.

Annexure A:
Amend condition 1.3.1 as follows:
1.3.1 Condition C.6A.1.(b): to be amended and carried forward to the title deed of the proposed subdivided portion noted as remainder erf 888 on the approved plan of subdivision in Annexure C:
That only 2 dwelling houses together with such outbuildings as are ordinarily required to be used therewith, be erected on this erf, save as provided in condition (c) hereof

Amend condition 1.3.2 as follows:
Condition C.6A.1.(d): The amendment to be carried forward to the title deed of the proposed subdivided portion noted as portion 1 on the approved plan of subdivision in Annexure C:

“That not more than 63% of the area of this erf be built upon”



Condition C.6A.1.(d): The amendment to be carried forward to the title deed of the proposed subdivided portion noted as the remainder of erf 888 on the approved plan of subdivision in Annexure C:

“That not more than 54% of the area of this erf be built upon”
