UNANIMOUSLY RESOLVED that:
An administrative penalty of R 100 000.00 BE DETERMINED for the unauthroised land use in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 17640, Paarden Eiland.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following changes:

Correct reason 6.2 as follows:
6.2 The duration of the contravention is 18 months which is considered as long, although it is acknowledged that the events happen periodically (twice a month according to the applicant).

Add reason 6.6 as follows:
6.6 This panel regards the contravention as extremely serious, given the duration, extent and the safety concerns. Therefore a much higher penalty is warranted.

Add reason 6.7 as follows:
6.7 Should there be an incident (eg a fire), this would result in serious reputational damage to the City of Cape Town
