RESOLVED UNANIMOUSLY

That an administrative penalty in the amount of R9500.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 117993 Cape Town at Plumstead in respect of the unauthorised early childhood development centre as per plan drawn by L.T. Hardenberg, with drawing number 19/JLW-02 Rev.3, dated 03-07-2020.

REASONS FOR DECISION:

The MPT APROVED the application for the reasons set out in the Planner’s report and added an additional reason 6.7 that reads as follows:

6.7 That a higher penalty is warranted because:
- Misrepresentation by the applicant
- The applicant was guilty of previous contraventions
- The gravity is serious
- this is a commercial undertaking and the applicant should be aware of and follow the correct procedures.
