UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 200.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 12194 Milnerton, for the unlawful swimming pool, and such penalty be approved in terms of Section 98(b) of the said By-Law.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following reason:
This is a contravention of the Municipal Planning By-Law for which the owner must take responsibility, therefore a minimal penalty is warranted, which was determined to be R 200.00
