Resolution details

UNANIMOUSLY RESOLVED that:
a. The rezoning from Agriculture (AG) to Transport Zoning 1 (TR1) of a portion of Portion 6 of the Farm No. 32, Brakkefontein BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015 (as amended);

b. The consent use to permit an airport (private airfield) on a portion of Portion 6 of the Farm No. 32, Brakkefontein BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015 (as amended);

c. The consent to permit an additional dwelling unit in accordance with plan no 812-3 on Portion 6 of the Farm No. 32, Brakkefontein BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015 (as amended);

d. City approval to accommodate an airport (private airfield) and additional dwelling unit within the Koeberg Restriction Area Overlay Zoning BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015 (as amended); and

e. The regulation departure in order to allow a main and second dwelling unit at 3,5m in lieu of 30m on Portion 6 of the Farm No. 32, Brakkefontein BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015 (as amended), in accordance with plan no. 812-3-Rev 1, subject to the conditions set out in Annexure A.

REASONS FOR DECISION
The MPT partially REFUSED and partially APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 7.1.1 as follows:

The proposal does not comply with Sections 99(1) and 99(3) of the Municipal Planning By-Law and thus it is not considered to be desirable.
