UNANIMOUSLY RESOLVED that:
An administrative penalty of R 4 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015, for the unauthorised building work (balcony) on Erf 370 Oranjezicht which contravenes the DMS.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following reason:
The balcony is situated at the rear of the property and has no significant negative impact, and this warrants a reduction in the penalty
