UNANIMOUSLY RESOLVED that:
a. The application for the removal of title deed and land use condition, as set out in Annexure A, on Erf 3299 (Portion of Erf 585) Camps Bay, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C.
b. The application for departures as set out in Annexure A, on Erf 3299 (Portion of Erf 585) Camps Bay, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following reason:
The street address indicated in the advertising notice was taken from the City of Cape Town GIS system and the MPT panel does not agree with the allegation of unfair procedure and is of the view that there are no grounds for a procedural flaw based on the objectors’ assertion in this regard
