UNANIMOUSLY RESOLVED that:
a. The application for the amendment of a restrictive title deed condition, as set out in Annexure A, for Erf 1159, Pinelands, BE APPROVED in terms of Section 98(b) of the City of Cape Town Planning By-Law, 2015.
b. The application for departures, as set out in Annexure A, for Erf 1159, Pinelands, BE APPROVED in terms of Section 98(b) of the City of Cape Town Planning By-Law, 2015, subject to the conditions contained in Annexure A, in accordance with the Site Development Plan in Annexure C.
c. The application for Consent, as set out in Annexure A, for Erf 1159, Pinelands, BE APPROVED in terms of Section 98(b) of the City of Cape Town Planning By-Law, 2015, subject to the conditions contained in Annexure A, in accordance with the Site Development Plan in Annexure C.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following reason:
Conditions will be imposed to address concerns raised by the objectors
Amend Annexure A:
1.3.2 Departure to permit the proposed outbuilding to be set back 1.477m in lieu of 3m from the east common boundary.
2.3 The place of instruction shall only operate between the hours of 7:00 and 18:00 on Mondays to Fridays and shall not operate on public holidays, Saturdays and Sundays
