UNANIMOUSLY RESOLVED that:
a. The application for a consent, for the establishment of a 4-bedroom guest house on Erf 4225, 1 Bulbine Street, Gordon’s Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 04543-SDP-yeomans-GB4225-rev02, pages 1 to 5, dated 19 July 2019, subject to the conditions contained in Annexure A hereto;

b. The application for a permanent departure for the under-provision of on-site parking by 1 bay (6 bays in lieu of the required 7) on Erf 4225, 1 Bulbine Street, Gordon’s Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 04543-SDP-yeomans-GB4225-rev02, pages 1 to 5, dated 19 July 2019, subject to the conditions contained in Annexure A hereto;



c. The application for a permanent departure to relax the south-western common boundary building line from 4,5m to 1,5m, to accommodate portions of guest room 1, within the ground floor of the existing building on Erf 4225, 1 Bulbine Street, Gordon’s Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 04543-SDP-yeomans-GB4225-rev02, pages 1 to 5, dated 19 July 2019, subject to the conditions contained in Annexure A hereto;

d. The application for a permanent departure to relax the south-western common boundary building line from 4,5m to 1,5m, to accommodate portions of guest rooms 3 and 4, within the first floor of the existing building on Erf 4225, 1 Bulbine Street, Gordon’s Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 04543-SDP-yeomans-GB4225-rev02, pages 1 to 5, dated 19 July 2019, subject to the conditions contained in Annexure A hereto;

e. The application for a permanent departure to relax the 4,5m street building along Boundary Road to 3,075m, to accommodate a new entrance lobby to the first floor of the existing building on Erf 4225, 1 Bulbine Street, Gordon’s Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 04543-SDP-yeomans-GB4225-rev02, pages 1 to 5, dated 19 July 2019, subject to the conditions contained in Annexure A hereto;

f. The application for a permanent departure to relax the 4,5m street building along Bulbine Street to 2,963m, to accommodate a portion of guest room 2, to the first floor of the existing building on Erf 4225, 1 Bulbine Street, Gordon’s Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 04543-SDP-yeomans-GB4225-rev02, pages 1 to 5, dated 19 July 2019, subject to the conditions contained in Annexure A hereto;

g. The application for a permanent departure to permit the reversing of vehicles across the sidewalk BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 04543-SDP-yeomans-GB4225-rev02, pages 1 to 5, dated 19 July 2019, subject to the conditions contained in Annexure A hereto;

h. The application for a permanent departure to permit carriageway crossing width of 2,5m, in lieu of minimum 2,7m on Erf 4225, 1 Bulbine Street, Gordon’s Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 04543-SDP-yeomans-GB4225-rev02, pages 1 to 5, dated 19 July 2019, subject to the conditions contained in Annexure A hereto;



i. The application for a permanent departure to permit vehicular access to within 2,991m from the prolongation of street boundaries at an intersection, in lieu of the required minimum of 10m on Erf 4225, 1 Bulbine Street, Gordon’s Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 04543-SDP-yeomans-GB4225-rev02, pages 1 to 5, dated 19 July 2019, subject to the conditions contained in Annexure A hereto.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
