RESOLVED UNANIMOUSLY

That an administrative penalty in the amount of R0 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 2983 Constantia with regard to the unauthorised place of instruction in the form of an Early Childhood Development Centre on the property.

REASONS FOR DECISION:

The MPT APPROVED the application for the following reason

1. The conduct of the applicant is not an issue in this instance as it can be reasonably assumed that by renting a property from the City for the express intension of operating an ECD Centre that the land use rights would have been in place.
