UNANIMOUSLY RESOLVED that:

a. The application in terms of Section 42(h) for the Consent from Council to allow for the relaxation of condition in Title Deed T60569/2011 Clause C6(b)to allow for the proposed carport at 2.35m in lieu of 4.72m (street) and 0m in lieu of 1.57m (common) BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law, 2015.

b. The application in terms of Section 42(j) of the City of Cape Town Municipal Planning By-Law, 2015 for Amendment of Condition of Township Approval to allow for the proposed carport at 2.35m in lieu of 4.72m (street) and 0m in lieu of 1.57m (common) BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law, 2015.

c. The application in terms of Section 42(b) for the relaxation of the of the 5m street building applicable to carports (along Thibault Avenue) to 2.35 to allow for the proposed carport BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law, 2015.

d. The application in terms of Section 42(b) for the relaxation of the 6.5m permissible width to 8.5m to allow for the proposed carport BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law, 2015.


e. The application in terms of Section 42(b) for the relaxation of the 3m common building line (adjacent to erf 58) to 2.456m to allow for the proposed second dwelling BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to:

Amend 10.1.4
The proposed second dwelling and carport will be screened by the existing large trees and shrubs and will be placed at a substantial distance from the objectors dwelling with the closest structure/s being the swimming pool and braai area.

Add new 10.1.6:
The objector supports the relaxation to permit the outbuilding to be 2.456m from the lateral boundary of erf 58.
