UNANIMOUSLY RESOLVED that:
a. The application in terms of Section 42(b) for the relaxation of the 6m common building line (adjacent to erf 15056) to 2.688m in order to regularise the existing second dwelling (garage converted into 2nd dwelling) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with drawing number 04015|pranzas|ssw15057|rev01 dated October 2017.
b. The application in terms of Section 42(b) for the relaxation of the 6m common building line to 3.552m to allow for the regularisation of an existing lapa BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with drawing number 04015|pranzas|ssw15057|rev01 dated October 2017.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 10.1.4 as follows:
The lapa is at a height of 3.7m.
NOTE: The objectors claim to have witnessed two wooden structures against their boundary wall. Enforcement officials to investigate the two wooden structures against the objectors’ property to determine whether the structures comply with the DMS.
