UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 52 000.00 BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of the unauthorised land use and building work on Erf 1356, 191 Irene Avenue, Somerset West.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend 6.4 as follows:
The owner was aware of the unauthorised use and building work, but took a couple of years before he decided to rectify it – the conduct is considered to be willful.
