UNANIMOUSLY RESOLVED that:
An administrative penalty of R 24 000.00 BE APPROVED for the unauthorised building work in terms of Section 98(b) of the City of Cape Town Municipal Planning Amendment By-Law, 2016 in respect of Erf 513, Bantry Bay.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to:
Amend 6.2:
A written complaint was received from an immediate neighbour and a compliance notice for deviating from the approved building plan was served.
Add new 6.5:
The applicant’s conduct is considered to be willful.
