RESOLVED UNANIMOUSLY

That an administrative penalty in the amount of R171 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 73891 Cape Town at Plumstead for the unauthorised dwelling and related building work on the subject property.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report except reasons 6.6 and 6.7 which are amended as follows:

6.6. The person involved, as a conveyancing attorney, is aware of the law and having been involved in previous planning applications and contraventions on other properties, is well aware of the need for both planning and building plan approval. The conduct of the person involved is willful.
6.7. The person involved has previously contravened the Municipal Planning By-Law, 2015 and the Land Use Planning Ordinance, 1985 and penalties of R100 000 were previously imposed by the MPT on two occasions on the same person.
