UNANIMOUSLY RESOLVED that:
a. The application for rezoning of Erf 19716, Somerset West, from Single Residential Zone I to Local Business Zone I BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in attached Annexure A.
a. The application for regulation departure from the Cape Town DMS for Erf 19716, Somerset West, to permit the relaxation of the 3,5m street building line (Parel Vallei Avenue) to 1,94m to regularise the conversion of the dwelling into offices BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The application for regulation departure from the Cape Town DMS for Erf 19716, Somerset West, to permit the relaxation of the 3m common building line (adjoining Erf 1908, Somerset West) to 1,5m for the proposed 2 flats BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The Site Development Plan No 09/2018 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and included additional reasons:
6.1.5 The impact of the departure adjacent to erf 1908 is not regarded as having any material significance given the fact that there are no overlooking features at 1st floor level
6.1.6 The nature of the development on erf 1908 is such as to not be disadvantaged by the relaxation of the building line
6.1.7 Placement of the building in the proposed location would provide additional buffering from the day to day use of the office component
6.1.8 The location of the flat component building will facilitate onsite movement of vehicular traffic
Amend Annexure A:
Delete paragraph 2
Paragraph 2.1 must be renumbered to 1.3
Paragraph 2.2 must be renumbered to 1.4
Paragraph 3 must be renumbered to 2 ‘Conditions of Approval’
Condition 3.1.1 must be renumbered to 2.1.1 and must read as follows:
That a Landscaping Plan be submitted for approval by the Director: Development Management prior to approval of any building plans.
Paragraph 3.1.2 becomes 2.1.2; 3.13 becomes 2.1.3 and 3.1.4 becomes 2.1.4.
Update numbering sequence accordingly
