RESOLVED that:
The application for a temporary land use departure in terms of Section 42(i) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit the operation of a tyre shop from the portion of the property on erf 6761, Westridge, Mitchells Plain, BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and agreed to add:
7.4 The proposal does not satisfy the desirability threshold criteria contained in Section 99 of the Municipal Planning By-Law
