UNANIMOUSLY RESOLVED that:
An administrative penalty for the unauthorised ECD Centre in the amount of R 300.00 in terms of Section 129 of the City of Cape Town Municipal Planning Amendment By-Law, 2016 in respect of erf 30751, 27 Hobe Street, Ilitha Park, Khayelitsha, BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:
6.5 The gravity of the contravention is considered to be serious given the particular health and safety requirements associated with ECDs.
