UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 2 000.00 for the unauthorised land use (ECD Centre) and R0 for the unauthorised building work in terms of Section 129 and Section 42(r) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 6908,21 Dludaka Close, Philippi, BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:
6.5 The gravity of the contravention is serious given the particular health and safety requirements associated with ECD’s.
