RESOLVED UNANIMOUSLY

That the application for a departure, as set out in Annexure A, for Erf 38163, Cape Town at Athlone, BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law, 2015 in accordance with building plan attached hereto as Annexure C1, subject to the conditions contained in Annexure A.

Condition 2.1 is amended as follows:

2.1 That the development of the property be generally in accordance with the Plan No. 100-01, dated 29 September 2017 attached hereto as Annexure C1.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 7.1.3 which is amended as follows:

7.1.3. The proposed height departure will not have a significant impact on the privacy, natural light, property values and general enjoyment of any of the abutting properties.
