RESOLVED UNANIMOUSLY
a. That the application for deletion of restrictive title deed conditions, as set out in Annexure A, for Erven 64149 & 64150 Cape Town at Kenilworth, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. That the application for deletion of conditions of an existing approval, as set out in Annexure A, for Erven 64149 & 64150 Cape Town at Kenilworth, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. That the application for Council’s consent in terms of title deed condition B(5) contained in Deeds of Transfer T96582/2007 & T27700/2006 to permit the subdivision of Erven 64149 & 64150 Cape Town at Kenilworth, in accordance with the plans of subdivision LUM/00/64149 & LUM/00/64150, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
d. That the application for the subdivision of the Erf 64150 Cape Town at Kenilworth, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/00/64150, subject to the conditions contained in Annexure A.
e. That the application for consolidation of Portion A of Erf 64150 with Erf 64149 Cape Town at Kenilworth as per the plan of subdivision / consolidation LUM/00/64150, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
f. That the application for the subdivision of the consolidation of Portion A of Erf 64150 with Erf 64149 Cape Town at Kenilworth, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/00/64149, subject to the conditions contained in amended Annexure A.
g. That the application for departures, as set out in amended Annexure A, for Erven 64149 & 64150 Cape Town at Kenilworth, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
Condition 3.1 on the amended Annexure A, is amended as follows:
3.1 Until occupancy certificates are issued for the buildings on Portion 1 – 6, the property shall (subject to 3.2 below) be developed generally in accordance with the plans drawn by Kevin Gadd Architects with drawing numbers 1702/SDP/A/04 & 1702/SDP/B/04 both dated 19.06.2018 and 1702/SDP/03 dated 19.06.2018 (2 pages).
Additional Condition
3.2 That no bedroom window be permitted on the north side of the building encroaching the 3m building line, on the first floor of portion 1 and that the existing proposed window be moved to the east side of the building
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 7.1.1 which is amended as follows:
7.1.1 The proposal is compatible with the surrounding land uses and will not change the character of the area and will not have a significant negative impact on neighbouring properties.
