RESOLVED UNANIMOUSLY
a. The application for the approval of Council in respect of the building in a Heritage Protection Overlay zone as contained in Annexure A attached in respect of Erf 9644, bounded by Longmarket, Bree, Church and Loop Street, Cape Town, BE APPROVED, in terms of Section 98(b) of the Municipal Planning By-Law subject to Conditions contained in Annexure A .
b. The application for the departures as contained in Annexure A attached in respect of Erf 9644, bounded by Longmarket, Bree, Church and Loop Street, Cape Town, BE APPROVED, in terms of Section 98(b) of the Municipal Planning By-Law subject to Conditions contained in Annexure A .
Condition 1.1 in Annexure A is amended as follows:
1.1 In terms of Item 162 to permit the alterations of the property to accommodate the proposal, to be substantially in accordance with Annexure C, (Drawing Numbers 01-03-001 to 01-03-026, 02-03-001 to 02-03-002 and 03-03-001 to 03-03-004 dated 09 April 2017 by dhk Architects), but to be revised and elaborated upon as per condition 3.1
Condition 3.1 is amended as follows:
3.1 An amended SDP shall be submitted, responding to and demonstrating compliance with the design indicator recommendations of the Urban Design and Heritage studies, but in compliance with the approvals hereby granted.
Additional conditions
3.2 A management and allocation plan be provided for the parking contained within the building envelope complying with the Title Deed Restrictions.
3.3 Night lighting and signage must be in accordance with the recommendations in the Urban Design report.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that reads as follows:
- Notwithstanding the principles contained in SPLUMA, the MPT is not in a position to delay decision-making in the absence of an appropriate Council policy framework or impose conditions in the absence of a legally binding set of criteria and mechanisms to guide the implementation of inclusionary housing in private developments
