RESOLVED UNANIMOUSLY

That an administrative penalty in the amount of R800 BE APPROVED in terms of Section 129(1) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 3104, Bellville.
REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report and amended reasons 2, 3 and 4 which read as follows:

2. The number of the 12 excess children currently do not pose any threat as to the owner already has consent for 24 children.
3. Nature and gravity of the contravention is moderately serious and the impact of the activity is not any different to what is approved.
4. The owner complied timeously with the requirements for a submission of an admin penalty application
