RESOLVED UNANIMOUSLY

a. That the application for the consolidation of Erven 5353, 5344 and Remainder Erf 5352 Bellville BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the plan of consolidation attached as Annexure C, subject to conditions contained in Annexure A.

b. That the application for the rezoning of the consolidated land parcel from Single Residential (SR1) to General Business (GB1) BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 to permit a mixed use development, subject to conditions contained in Annexure A.

c. That the application for permanent departures relating to a building lines, parking and access, as set out in Annexure A, for the consolidated land parcel BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, subject to conditions contained in Annexure A.

d. That the application for Council’s approval, as set out in Annexure A, for the consolidated land parcel BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, subject to conditions contained in Annexure A.

Condition 2.1.1 and 2.2.2 are amended as follows:

2.1.1 The development shall be in accordance with a revised SDP to be submitted for approval by an authorized official with confirmation from the urban design branch that the revised proposals are consistent with Urban Design Policy, and shall deal specifically with an improved and more activated interface with the future Durban Road and Herbert Street and in particular adequate provision for landscaping shall be made.

2.2.2. The owner shall pay a financial contribution toward the provision of municipal services in the amount of R582 267 in accordance with the prescribed policy.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report, deleted reason 7.1.3 and added an additional reason 7.2

7.2 The proposed design of the building is not supported and a revised SDP which is consistent with Council’s Urban Design Policy be submitted to the authorized/delegated official
