UNANIMOUSLY RESOLVED

a. That the application for rezoning of erf 13095, Milnerton, from Single Residential 1 to Local Business 1, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, subject to the conditions attached as annexure A.

b. That the application for permanent departure in respect of erf 13095, Milnerton, in order to relax the 3,0m common boundary building line, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, only in so far as to allow the existing structures to be used for office purposes (medical consulting rooms).

c. That the application for permanent departure in respect of erf 13095 Milnerton, in order to provide 6 on-site parking bays in lieu of the required 12 bays for the proposed 3 medical consulting rooms, BE REFUSED. in terms of Section 98( c) of the Municipal Planning By-law, 2015, but the departure from 8 to 6 bays BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015 in the event of the medical facility being limited to 2 consulting rooms/2 practitioners only., in terms of Section 98(c) of the Municipal Planning By-law, 2015.

d. That the application for approval of the Site Development Plan, No. 216/09/1261/no.1, dated 23 September 2016, in respect of erf 13095 Milnerton, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.


Condition 2.1 and 2.2 are amended as follows:

2.1 That a detailed Site Development Plan for the conversion- and use of the property for the purposes of offices/medical consulting rooms be drawn up in consultation with the Directorate Development management: TIA and Development Control and be submitted for approval by the authorized official prior to the use of the property in accordance with the rezoning approval. The Site Development Plan shall include the following:

2.2 The use of the property is limited to only medical consulting rooms/offices, including a maximum of 2 medical consulting rooms with a maximum of 2 medical practitioners that may practice on the property.

REASONS FOR DECISION:

The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s report
