RESOLVED UNANIMOUSLY

a. That the application for rezoning from Single Residential 1 to Subdivisional Area to permit the development of the SR1 and a private road portions on the Remainder Erf 4383, Durbanville BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the plan attached as Annexure C1 and subject to the conditions contained in Annexure A.

b. That the application for subdivision of Remainder Erf 4383, Durbanville into 5 SR1 portions (i.e. including the new remainder) and 1 private open space portion (i.e. private road) BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the plan attached as Annexure C1 and subject to the conditions contained in Annexure A.

c. That the application for consolidation of Portion 5 of the Remainder Erf 4383, Durbanville with Erf 15030, Durbanville BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the plan attached as Annexure C1 and subject to the conditions contained in Annexure A.

d. That the application for consolidation of Portion 6 of the Remainder Erf 4383, Durbanville with Erf 15922, Durbanville (Napa Valley private road) BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the plan attached as Annexure C1 and subject to the conditions contained in Annexure A.

Condition 2.2 is amended as follows:

2.2. The subdivision shall be in accordance with the subdivision plan dated 23/05/208 attached as Annexure C.1

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report except reasons 7.3 and 7.5 which is amended as follows:

7.3. The application is supported by the relevant internal Departments
7.5. Considering the above, the proposal is regarded to be desirable in terms of the criteria per Section 99(3) of the Municipal Planning By-Law, 2015. The decision making criteria in terms of Section 99(1) and 99(2) have also been complied with.
