RESOLVED UNANIMOUSLY
a. That the application for regulation departure in terms of Section 42(b) of the Municipal Planning By-Law, to permit the garage to be setback 4.5m (Bo Verwachting Street) and 1.357m (Cestrum Street) in lieu of 5.0m from the street boundary in respect of Erf 4735, Eversdale, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. That the application for a regulation departure in terms of Section 42(b) of the Municipal Planning By-Law, to permit the balcony to be setback 1.5m in lieu of 3.0m from the common boundary in respect of Erf 4735, Eversdale, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. That the application for a regulation departure in terms of Section 42(b) of the Municipal Planning By-Law, to permit the first floor dwelling extensions to be setback 1.2m in lieu of 3.0m from the common boundary in respect of Erf 4735, Eversdale, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 7.1.2 which is amended as follows:
7.1.2. The proposed building line departures will not have a significant negative impact on the abutting property.
