RESOLVED UNANIMOUSLY

That an administrative penalty in the amount of R150 924.00 BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 8372, 1 Maranon Street, Delft.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 1 which is amended as set out below and added 3 additional reasons.

1. The owner and / or service provider were fully aware of the rules and procedures required to obtain Council’s approval, prior to commencement of any construction on the premises but continued with the unauthorized activity.

Additional reasons

- The public have been denied the opportunity to comment prior to construction
- Council has not been given an opportunity to verify policy compliance or ascertain public opinion prior to construction of this significant land use transgression.
- The applicant’s motivation is unacceptable because he cannot erect a mast without authorization, just because of a high demand.
