UNANIMOUSLY RESOLVED that:

a. The application in terms of Section 42(l) of the City of Cape Town Municipal Planning By-Law, 2015 for the amendment of the Subdivision Plan No. J6243_SUB_& PP_16 dated July 2009, concerning Remainder Erf 644, Schaapkraal, date stamped by Council 17/09/2014, by the replacement thereof with subdivision plan no. drawing no. 2608 – S1 - 02 dated 20 February 2017 (see Annexure C), BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.

b. The application in terms of Section 42(l) of the City of Cape Town Municipal Planning By-Law, 2015 for the deletion of all previous conditions of approval, as contained in the letter of approval dated 11 September 2009, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015.




c. The application for permanent departures in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit:
- Common boundary building line setbacks of 1m in lieu of 3m for freestanding single dwelling unit housing typologies (erven with portions over 12m from the street) and 1m in lieu of 1.5m for windows (all house typologies - single residential 1 zoned erven)
- Street building line setbacks of 0m in lieu of 1m (dwelling houses) and 1.5 (garages) (all house typologies - single residential 1 zoned erven)
BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend as follows:

7.1.3 The proposal will contribute to accommodating an appropriate mix of residential and non-residential uses at suitable densities.

Amend Annexure A:
2.1 The following zonings will be applicable in accordance with the attached subdivision plan no. drawing no. 2608 – S1 - 02 dated 20 February 2018 (see Annexure C):

2.4 The developer shall, at his/her cost, construct surfaced sidewalks and cycle paths along both sides of the Weltevreden Parkway extension from the access road to the north of the subject property (i.e. the intersection of the existing Weltevreden Parkway and proposed Weltevreden Parkway extension) to the intersection of Wespoort Road and the proposed Weltevreden Parkway extension.

Correct the numbering sequence in Annexure A.
