UNANIMOUSLY RESOLVED that:

a. The application for a consent use to permit an Institution for the care of physically and mentally challenged children on Erf 3303, Somerset West, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law.

b. The application for a departure to permit the building on Erf 3303, Somerset West to be set back 3m in lieu of 5m from the street boundary (Bridgewater Street), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law.

c. The application for a departure to permit the building on Erf 3303, Somerset West to be set back 3m in lieu of 5m from the common boundary with Erf 3304, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law.

d. The application for a departure to permit the building on Erf 3303, Somerset West to be set back 0m in lieu of 5m from the common boundary with Erf 3305, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law.

e. The application for a departure to permit the building on Erf 3303, Somerset West to be set back 3m in lieu of 5m from the common boundary with Erf 3302, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law.

REASONS FOR DECISION
Here is a summary of reasons for approval that emerged from the discussion:

1. The proposed Institution for the care of physically and mentally challenged children is considered compatible with the surrounding area
2. The proposed Institution is considered to be an integral part of social infrastructure required to serve residential environments
3. The application is desirable as the built form is not extensive
4. The proposal will have no significant adverse impact on the immediate area
5. Adequate supervision and Health & Safety measures shall be put in place



The case officer must formulate conditions with respect to the slab level which must be above the flood line and circulate to the 3 remaining panel members for approval.
