Resolution details

UNANIMOUSLY RESOLVED that:

a. The application for a consent, in order to utilize Erf 1963, 3 Melkboom Road, Gordon’s Bay for institutional purposes (in-patient substance abuse rehabilitation centre), BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 1963gby-001 dated March 2018, subject to the conditions contained in Annexure A hereto;

b. The application for a permanent departure, for the relaxation of the 5m building lines applicable to institutional buildings, to between 4.5 and 0m, in order to accommodate the existing buildings under the aforesaid consent use, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 1963gby-001 dated March 2018 subject to the conditions contained in Annexure A hereto;

c. The application for a permanent departure, for the under-provision of on-site parking by 2 bays, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 in accordance with plan no. 1963gby-001 dated March 2018, subject to the conditions contained in Annexure A hereto.


REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend as follows:

7.7 Imposed conditions will mitigate concerns about negative impacts of the proposed development on the surrounding area.

Amend Annexure A:

2.1.2 That the consent be valid for a period of 5 years from date of final notification.
1.1.3 That the facility accommodate a maximum of 6 patients
2.1.5 That Council reserves the right to impose additional conditions or to withdraw this approval in the event of a nuisance being created or non-compliance with any of the imposed conditions, by serving the applicant 60 days’ written notice
