Resolution details

RESOLVED that:

a. The application for Council’s Consent for relaxation of Condition C.3(d) of the Title Deed for Erf 2343, Somerset West, to permit an outbuilding within the stipulated 6,3m street building line and 3,15m common building line BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The application for regulation departure from the Cape Town DMS for Erf 2343, Somerset West, to permit the relaxation of the 6m street building line (Windsor Road) to 1m for an outbuilding (garage and display space for antique/special vehicles) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. The application for regulation departure from the Cape Town DMS for Erf 2343, Somerset West, to permit an outbuilding with a street frontage of 22,7m in height in lieu of 6,5m BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

d. The application for regulation departure from the Cape Town DMS for Erf 2343, Somerset West, to permit a vehicular ingress/egress closer than 10m to the intersection of Seaview Road and Windsor Road BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

e. The application for regulation departure from the Cape Town DMS for Erf 2343, Somerset West, to permit 2 carriageway crossings onto Windsor Road BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

f. The application for regulation departure from the Cape Town DMS for Erf 2343, Somerset West, to permit an outbuilding (garage and display space for antique/special vehicles) of 5,558m within the 3m common building line in lieu of a maximum height of 3,5m BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT APPROVED this application for the following reasons:

1. The development proposal will not have a significant effect on the current streetscape as the impact has been mitigated by reducing the carriageway crossing and the planned landscaping
2. No additional negative traffic impact is anticipated
3. The proposed location of the addition will optimize the use of the developable space on the property
4. The elevation and setbacks as depicted on page 302 and 303 is considered to fit in with the general streetscape in the area, which must be tied to conditions

Delete reasons contained in the case officer’s report.


Amend Annexure A:
Add: The development shall be generally in accordance with the plans REV01 Nov 2017 as indicated in Annexure C of the case officer’s report.

Add: The additional garage may only be used for the parking of the owner’s vehicle and may not be used for the displaying of vehicles for business purposes.
