UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 29 250.00 for the unauthorised land use (conversion of 5 farmworkers’ cottages into permanent residential accommodation) BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, in respect of Farm Morgenster 1319 (Morgenster Estate).
REASONS FOR DECISION
The MPT APPROVED the application for the following reasons:
1. This is a longstanding land use contravention with significant impact
2. The applicant has received substantial financial benefit from the unauthorized use
