RESOLVED UNANIMOUSLY
a. That the application for rezoning of Erf 129009 Cape Town at Newlands from General Business Subzone GB1 to General Business Subzone GB6, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions as set out in Annexure A.
b. That the application for departures, as set out in Annexure A, for Erf 129009 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
Application 1.1.1 is amended as follows:
1.1.1 Rezoning of the property from General Business Subzone GB1 to General Business Subzone GB6
Condition 2.2.9 is deleted
Condition 2.5.2 is amended as follows:
2.5.2 The approved landscaping plan shall be implemented by and at the cost of the owner/developer, in accordance with the implementation plan, within 1 year of practical completion of building work. Implementation shall be substantially in accordance with the approved plan to the satisfaction of the Director: Environmental Management.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that reads as follows:
7.1.14 Notwithstanding the principles contained in SPLUMA, the MPT is not in a position to delay decision-making in the absence of an appropriate Council policy framework and an agreed upon set of criteria and mechanisms to guide the implementation of inclusionary housing in private developments
