RESOLVED

a. That the application for the rezoning of Erf 6686 Constantia, from Single Residential Zone 1 to General Residential Subzone GR2, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

b. That the application for consents in terms of Item 40(b) of the Development Management Scheme to permit a place of instruction and hospital on Erf 6686 Constantia, BE REFUSED in terms of section 98(c) of the Municipal Planning By-Law, 2015.

c. That the application for departures, as set out in Annexure A, for Erf 6686 Constantia, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

1. The proposal is not consistent with the District Plan and sufficient circumstances have not been motivated to justify a deviation.
2. The property is not part of an area identified in terms of planning policy for business or use intensification and therefore the rezoning of the property is inappropriate.
3. Inadequate provision for the retention of the residential component.
4. The application does not present a spatial logic for a rezoned site or hospital on the site.
