a. That the application for Consent Use in respect of Erf 24413, Bellville to permit the installation of a freestanding telecommunication mast base station BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions, attached as Annexure A.
b. That the application for permanent Departure in respect of Erf 24413, Bellville for relaxation of the 5m common building line on the Western boundary, adjacent to remainder erf 23218 BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law subject to the conditions, attached as Annexure A.
c. That the application for permanent departure in respect of Erf 24413, Bellville for relaxation of the 5m common building line on the Southern boundary adjacent to erf 38352 BE REFUSED in terms of Section 98 (c) of the City of Cape Town Municipal Planning By-Law, 2015
Application 1.1 and 1.2 are amended as follows:
1.1 Consent Use in order to permit the installation of a 21m high freestanding Cellular Communication Base Station on the premises.
1.2 Departures: relaxation of the 5m common building line (on the western boundary, adjacent to remainder erf 23218) to 0M to accommodate a freestanding cellular mast base station.
APPLICATIONS REFUSED IN TERMS OF SECTION 98 (c) OF THE BYLAW
1.3 Departures: Relaxation of the 5m common building line (on the Southern boundary, adjacent to Erf 38252) to 0M to accommodate freestanding Cellular Mast Base Station
Condition 2.1 is amended as follows:
2.1 That a revised site layout plan reflecting the above decision be submitted for approval by the Director: Development Management prior to building plan approval..
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report.
Reason for REFUSAL of the departure on the Southern boundary
1. The location of the cell mast away from the southern boundary will minimize impact on the mosque.
