RESOLVED UNANIMOUSLY
a. That the application for rezoning of erf 10145, Bellville, from Single Residential 1 to Local Business 1, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with the Site Development Plan No. B10145/SDP, dated 12 September 2016, drawn by Diverse Design, subject to the conditions contained in Annexure A
b. That the application for permanent departure in respect of erf 10145, Bellville, in order to relax the 3,0m common boundary building line, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, only in so far as to allow the existing structures to be used for office purposes, in accordance with the Site Development Plan, No. B10145/SDP, dated 12 September 2016, drawn by Diverse Design, subject to the conditions contained in Annexure A
c. That the application for permanent departure in respect of erf 10145, Bellville, in order to provide 6 on-site parking bays in lieu of the required 7 bays, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with the Site Development Plan, No. B10145/SDP, dated 12 September 2016, drawn by Diverse Design, subject to the conditions contained in Annexure A
d. That the application for permanent departure in respect of erf 10145, Bellville, in order to allow the reversing of vehicles from on-sit parking bays (indicated as “P5” and “P6) across the sidewalk along 2nd Avenue, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with the Site Development Plan, No. B10145/SDP, dated 12 September 2016, drawn by Diverse Design, subject to the conditions attached as annexure A.
That the word on-site be spelled correctly in Application 1.2.3
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 7.1.5 which is amended as follows:
7.1.5 Subject to the conditions attached as Annexure A, it will not have a negative impact on the existing rights of surrounding owners.
