RESOLVED UNANIMOUSLY
a. That the application for removal of restrictive title condition D 3(a), (b), (c) & (d) and E2 of title deed T12350/2017 and the relevant holding deeds relating to Erf 1183, Durbanville BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.
b. That the application to delete the conditions removed per paragraph 8.1 above of the planning approval relating to the township establishment of which Erf 1183, Durbanville forms part, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law.
c. That the application for rezoning from Single Residential 1 to Subdivisional Area to permit the proposed single title group housing development on Erf 1183, Durbanville BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with the plan attached as Annexure C & D and subject to the conditions contained in Annexure A.
d. That the application for subdivision of Erf 1183, Durbanville into 6 group housing properties and a private road BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with the plan attached as Annexure C and subject to the conditions contained in Annexure A.
e. That the Regulation departure from the street building line from 5m to 4.5m to accommodate the garages on portion 1 and 6 of Erf 1183, Durbanville, BE APPROVED in terms of section 98 (b) of the Municipal Planning By-law, 2015, in accordance with the site plan attached as Annexure D and subject to the conditions contained in Annexure A.
Application 1.5 is omitted from Annexure A
Conditions 2.2, 2.7, 2.8, 2.9, 2.10, 2.11, 2.12, 2.13 and 2.14 are deleted
Condition 2.3 and 2.25 are amended as follows:
2.3 That a Site Development Plan (SDP) inclusive of Landscaping and an indication of Existing trees ro be retained shall be submitted for the approval by the Director: Development Management prior to building plan submission
2.25 That existing and/or new landscaping planted in the sight triangle may not influence the required shoulder sight distance from the access onto Hibiscus Road.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 7.9 which is deleted.
