RESOLVED UNANIMOUSLY

a. That the application for the rezoning of Erf 38061, Bellville from Single Residential Zone 1 and Transport Zone 1 to General Residential Zone 3, in terms of Section 42 (a) of the City of Cape Town Municipal Planning By-law, 2015, BE APPROVED in terms of Section 98 (b) of the By-law, subject to the conditions contained in Annexure A and in accordance with the plans attached in Annexure C.

b. That the Site Development Plan (SDP) in Annexure C BE APPROVED in terms of Section 22(i) in accordance with Drawing Numbers, 412 – 100 to 412 – 105, 413 – 101, 413 – 102, 414 – 101 and 414 – 102 dated16 August 2016, subject to conditions contained in Annexure A

1.2 Site Development Plan

Conditions 2.4, 2.7, 2.10 and 2.13 are amended as follows:

2.4. That a Landscaping Plan (including landscaping external to the site) shall be submitted by the developer and approved by the Director: Development Management prior to the submission of building plans.

2.7 That the applicant/developer shall adhere to the relevant recommendations of the Report on the Geotechnical Investigation of Erf 38061, Bellville, dated June 2008, compiled by Melis and Du Plessis Consulting Engineers, hereby attached as Annexure K, and that a geotechnical engineer be appointed to assist with the final design of the proposed building and monitoring accordingly the subsequent construction.

2.10. That all services be inspected by Council on completion of the works and a final completion certificate be obtained prior to transfer of individual units.

2.13. DC’s will be payable prior to any transfer of units approval of building plans or within 30 days of the approval of the land use where no transfer or building plans are required.

Conditions 2.18, 2.19, 2.20, 2.24 and 2.26 are deleted

The MPT APPROVED the application for the reasons set out in the Planner’s report.
