UNANIMOUSLY RESOLVED that:
a. The application for rezoning from Single Residential Zone 1 to Local Business Subzone 1, as set out in Annexure A, on Erf 1480 Pinelands, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.
b. The application for departures, as set out in Annexure A, on Erf 1480 Pinelands, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C.
c. The application for removal of restrictions of land use conditions, as set out in Annexure A, on Erf 1480 Pinelands, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 7.1.1 as follows:
The proposal complies with the Table Bay District Plan and encourages an appropriate mix of land use intensification.
Amend conditions:
Correct the numbering sequence in condition 2
Delete 2.2, renumber as 2.1 and replace as follows:
Amended building plans to be submitted and must be substantially in accordance with the plans drawn by PRO-KONSORT TOWN PLANNERS, Plan No. P/1480/1, dated 2017-03-23 (as indicated in the attached Annexure C), to the satisfaction of the Director: Development Management
Add new 2.2:
That a building plan shall be submitted in accordance with the development plan in Annexure C to indicate the changed use categories in the building.
Add new 2.3:
Before approval of the building plan, the applicant must apply for removal of the township establishment conditions applicable in terms of Ordinance 33 of 1934.
Add new 2.8:
That the residential character shall be maintained by providing a permeable fence and appropriate landscaping to the satisfaction of the Director: Development Management.
